The Allahabad High Court has set aside the Railway Board’s five-year ban on Jakson Ventures Private Ltd. (JVPL). The national transporter had banned JVPL after the diesel genset supplier forged documents certifying earnest money deposit (EMD) as bank guarantee in a bid called by the Railways’ Central Periodical Overhauling (CPOH) Workshop in Prayagraj.
In its petition against the ban, JVPL argued the Railway Board order was not reasoned. It also submitted that the ban was not passed by the competent authority. In addition to this, JVPL claimed the order was issued without considering objections which were raised.
JVPL argued that allegations against their company have been examined by Executive Director/Civil Engineering (G) of the Railway Board. But a decision to issue the ban has been made by the Ministry of Railway (Railway Board). Setting aside the ban, the High Court remitted it to the Competent Authority to pass a fresh order in accordance with law.
