AGRA Hearing an interlocutory application filed by Agra-resident KC Jain, the Supreme Court has ordered the road safety panel to ensure the implementation of provisions made for electronic monitoring. The panel has also been asked to enforce road safety norms on national highways, state highways, and other roads. Headed by Justice AM Sapre, the panel, formed earlier by the SC, has also been directed to submit a report in this regard.
Sharing further details, KC Jain, who is also the secretary of the Agra Development Foundation, said, “The SC, in its order on January 6, asked the chairperson of the panel to convene a preliminary meeting with the secretary in the ministry of road, transport and highways, the additional solicitor general and Gaurav Agarwal, amicus curiae (friend to the court) so that an agreed formulation can be placed before the SC for setting out modalities for implementing the provisions of Section 136A.”
He added, “The court has suggested holding a meeting within two weeks and presenting these modalities chalked out before this court so that the provisions of Section 136A can be enforced across the country.” The case will next be heard on February 6.
Notably, the Motor Vehicles Act 1988 was amended by Act 32 of 2019, inter alia, to incorporate the provisions of Section 136A making provisions for the electronic monitoring and enforcement of road safety on national highways, state highways, roads or in any urban city within a state. Pursuant to the provisions of sub-section (2) of Section 136A, rules have been framed by the Centre. The rules came into force on August 11, 2021.
“At present, the concern is ensuring the due enforcement of the provisions of Section 136A by drawing up state-specific implementation guidelines. This exercise would have to be conducted in collaboration with the state governments,” said Jain while pointing out that “due to the fast rise in the number of vehicles, only electronic monitoring can ensure safety on roads.” In his opinion, the SC has timely taken the initiative which may pave the way for safer roads monitored through latest technology while “ensuring challan on over speeding and other aspects of road safety”.
